Terms and Conditions

Agreement to These Terms

These Terms and Conditions govern your access to and use of commonwealth-psychotherapy.com and any related webpages or online features that link to these terms (collectively, the "Site").

The Site is operated by Commonwealth Psychotherapy, PLLC ("Commonwealth Psychotherapy," "we," "us," or "our"), a psychotherapy and clinical-supervision practice based in Massachusetts.

By accessing or using the Site, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with these terms, please discontinue use of the Site.

These terms govern use of the public Site only. Professional services are governed by separate intake documents, informed-consent agreements, supervision agreements, privacy notices, payment policies, and other practice documents.

1. Purpose of the Site

The Site provides general information about Commonwealth Psychotherapy, Julia Averna, LICSW, individual therapy, clinical supervision, practice policies, and ways to request an introductory consultation.

Content on the Site is provided for informational and educational purposes only. It is not psychotherapy, clinical supervision, medical advice, diagnosis, crisis intervention, legal advice, or an individualized professional recommendation.

You should not rely on Site content as a substitute for care, assessment, treatment, consultation, or supervision from an appropriately qualified professional who understands your individual circumstances.

2. No Professional Relationship

Visiting the Site, reading its content, submitting a contact form, sending an email, leaving a voicemail, or participating in an introductory consultation does not create a therapist-client, supervisor-supervisee, consultant, or other professional relationship.

A therapist-client relationship is established only after Commonwealth Psychotherapy and the prospective client agree to begin services and all required intake, informed-consent, payment, privacy, and practice-policy documents have been completed.

A clinical-supervision relationship is established only after eligibility and fit have been reviewed, both parties agree to the arrangement, and all required supervision documents have been completed.

3. Eligibility and Service Availability

The Site and the services described on it are intended for adults who are at least 18 years old. By submitting an inquiry, you represent that you are at least 18 years old and legally capable of providing the information submitted.

Individual therapy is available only when Julia Averna is legally authorized to provide services in the jurisdiction where the client is physically located at the time of the session.

Clinical supervision is available only when the proposed arrangement is consistent with applicable licensing, educational, employment, and professional requirements.

Prospective supervisees are responsible for confirming that a supervision arrangement satisfies the requirements of their school, employer, licensing board, credentialing organization, and any other applicable authority.

Information on the Site does not constitute an offer to provide professional services in a jurisdiction where doing so would violate applicable laws, licensing rules, or professional requirements.

4. Acceptance Into Services Is Not Guaranteed

Submitting an inquiry, requesting a consultation, completing an intake form, or participating in an introductory call does not guarantee acceptance into individual therapy or clinical supervision.

Commonwealth Psychotherapy may determine that services are unavailable or are not an appropriate fit based on availability, scope of practice, clinical needs, supervision requirements, location, scheduling, conflicts of interest, or other relevant considerations.

When appropriate and reasonably possible, Commonwealth Psychotherapy may suggest that an individual seek another provider, supervisor, resource, or level of care. A referral or suggestion does not guarantee that another professional will be available or appropriate.

5. Website Contact Forms and Communications

Contact forms, email, telephone, and voicemail may be used for general questions, consultation requests, and non-urgent administrative communication.

Please do not submit detailed clinical information, psychotherapy records, Social Security numbers, complete payment-card information, or other highly sensitive information through a general website form or standard email.

Electronic communications may not be completely secure, and no method of transmission can be guaranteed to be free from unauthorized access, interception, error, or delay.

Commonwealth Psychotherapy does not guarantee a particular response time. Submission of a message does not mean that the message has been received, reviewed, or accepted as a request for professional services.

6. Consent to Be Contacted

By submitting a contact or consultation form, you authorize Commonwealth Psychotherapy to respond using the contact information and communication preferences you provide.

Communications may include information about availability, scheduling, consultations, requested services, forms, and other administrative next steps.

Agreeing to receive nonessential marketing communications is not a condition of receiving professional services. You may unsubscribe from marketing emails using the unsubscribe link included in those messages.

7. Text-Message Terms

If you expressly agree to receive text messages, Commonwealth Psychotherapy may send administrative messages concerning consultations, scheduling, appointment reminders, forms, or other service-related information.

Message frequency may vary. Standard message and data rates may apply depending on your mobile carrier and plan.

You may opt out of nonessential text messages by replying "STOP" or by contacting Commonwealth Psychotherapy directly. You may reply "HELP" or contact the practice if you need assistance.

Mobile telephone numbers and text-message consent information will not be sold or shared with third parties for their independent marketing or promotional purposes.

Text messaging is not appropriate for emergencies or urgent clinical concerns.

8. No Emergency or Crisis Services

The Site, contact forms, email, voicemail, text messaging, and social-media accounts are not monitored continuously and must not be used for emergency or crisis communication.

Commonwealth Psychotherapy does not provide emergency response or crisis intervention through the Site.

If you are experiencing an emergency or are concerned about your immediate safety, call 911, call or text the Suicide & Crisis Lifeline at 988, or visit the nearest emergency department.

9. Fees, Billing, and Professional-Service Policies

Fees displayed on the Site are provided for general information and may change. The fee and payment terms that apply to professional services will be stated in the applicable service agreement or practice policy.

Payments for professional services may be processed through a secure third-party practice-management or payment-processing platform. The public Site does not directly store complete payment-card information.

Cancellation fees, missed-session fees, payment methods, insurance arrangements, refunds, and billing procedures are governed by the applicable signed practice or supervision documents.

You are responsible for confirming insurance benefits, reimbursement, health-savings-account eligibility, flexible-spending-account eligibility, and any other coverage directly with the relevant plan or administrator.

10. Good Faith Estimates

Individuals who are uninsured or who choose not to use insurance may have the right to receive a Good Faith Estimate of the expected charges for scheduled non-emergency healthcare services.

A Good Faith Estimate is an estimate based on the information available when it is prepared. It is not a bill, contract, guarantee, or promise that the scope or cost of services will never change.

If services, frequency, needs, or circumstances change, Commonwealth Psychotherapy may provide an updated estimate when required or appropriate.

11. Intellectual Property

Unless otherwise stated, the Site and its original content are owned by or licensed to Commonwealth Psychotherapy. This includes text, website designs, graphics, logos, branding, photographs, downloadable materials, videos, audio, and other original content.

Site content is protected by applicable copyright, trademark, and other intellectual-property laws.

You may view, download, or print reasonable portions of publicly available content for your personal, noncommercial use, provided that you do not remove copyright or proprietary notices.

You may not reproduce, republish, sell, license, modify, distribute, publicly display, scrape, create derivative works from, or commercially exploit Site content without prior written permission.

Sharing a direct link to a publicly available webpage or social-media post is permitted, provided the material is not altered or presented misleadingly.

12. Permitted Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not violate the rights of Commonwealth Psychotherapy or another person.

You agree not to:

  • Use the Site for fraudulent, unlawful, or deceptive activity
  • Submit false, misleading, harassing, or abusive communications
  • Attempt to gain unauthorized access to the Site or related systems
  • Interfere with the security or operation of the Site
  • Introduce malware, viruses, malicious code, or disruptive material
  • Use bots, scrapers, automated tools, or data-extraction methods except for standard search-engine indexing
  • Impersonate another individual or misrepresent your identity
  • Collect another person’s information without lawful authorization
  • Use Site content to compete with or misrepresent the practice
  • Infringe copyrights, trademarks, privacy rights, or other legal rights

We may restrict or block access to the Site when we reasonably believe that a user has violated these terms or created a security, legal, or operational risk.

13. Information and Feedback You Submit

You remain responsible for information you submit through the Site. You represent that you have the right to submit the information and that doing so does not violate another person’s rights or applicable law.

Contact-form messages and clinical inquiries will not be treated as testimonials, public contributions, or marketing content without separate authorization.

If you voluntarily provide general feedback or suggestions about the Site, you permit Commonwealth Psychotherapy to consider and use that feedback to improve the Site or services. This does not authorize the public use of confidential clinical or identifying information.

14. Third-Party Websites and Services

The Site may link to or embed third-party websites, client portals, scheduling platforms, forms, payment processors, social-media platforms, articles, or other resources.

Commonwealth Psychotherapy does not own or control these third-party services and is not responsible for their content, availability, security, accessibility, products, privacy practices, or terms.

The inclusion of a link or embedded feature does not necessarily constitute an endorsement or guarantee. Your use of a third-party service is governed by that provider’s own terms and privacy policies.

15. Social-Media Disclaimer

Content shared through social-media accounts associated with Commonwealth Psychotherapy or Julia Averna is provided for general informational and educational purposes.

Following an account, viewing content, liking or sharing a post, commenting, or sending a direct message does not create a therapist-client or supervision relationship.

Social-media comments and direct messages are not appropriate for clinical communication and may not be reviewed promptly. Do not share private health information or urgent safety concerns through social media.

16. Privacy

Use of the Site is also subject to the Commonwealth Psychotherapy Privacy Policy and Cookie Policy.

If you become a client, the handling of protected health information may also be governed by a separate Notice of Privacy Practices and clinical documents.

17. Accuracy of Information

We make reasonable efforts to keep Site information accurate and current. However, the Site may contain typographical errors, outdated information, omissions, or inaccuracies relating to fees, availability, services, credentials, policies, or other matters.

We reserve the right to correct, update, remove, or change Site content at any time without prior notice.

18. Site Availability and Modifications

The Site is provided on an "as available" basis. We do not guarantee that it will always be available, uninterrupted, secure, or free from errors.

Access may be interrupted by maintenance, technical problems, hosting issues, security concerns, events outside our control, or changes to the Site.

We may modify, suspend, discontinue, or remove any portion of the Site at any time.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided without warranties of any kind, whether express or implied.

Commonwealth Psychotherapy does not warrant that the Site will be uninterrupted, error-free, completely secure, or suitable for every visitor’s needs.

We do not guarantee any personal, therapeutic, clinical, professional, licensing, supervision, or financial outcome from using the Site or engaging in services.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Commonwealth Psychotherapy and its owner, employees, contractors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

  • Your access to, use of, or inability to use the Site
  • Your reliance on Site content
  • Errors, omissions, delays, or interruptions
  • Third-party websites, services, or content
  • Unauthorized access to information despite reasonable safeguards
  • Malware or harmful material transmitted by a third party

Nothing in these terms excludes liability that cannot legally be excluded or limited under applicable law.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Commonwealth Psychotherapy and its owner, contractors, and agents from third-party claims, damages, liabilities, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Site
  • Your material violation of these terms
  • Your infringement of another person’s rights
  • Malicious or harmful material introduced by you

22. Electronic Communications

By using contact forms or communicating electronically, you consent to receive responses and notices electronically at the contact information you provide.

Electronic communications may satisfy requirements that certain notices be provided in writing, to the extent permitted by applicable law.

This section does not replace any separate consent required for psychotherapy, clinical supervision, telehealth, electronic records, payment authorization, or protected health information.

23. Governing Law

These Terms and Conditions and disputes relating solely to use of the Site will be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles, to the extent permitted by applicable law.

Nothing in these terms limits rights or remedies that cannot be waived under applicable consumer-protection, healthcare, licensing, privacy, or other laws.

24. Informal Resolution of Website Disputes

Before filing a legal claim relating solely to use of the Site, you agree to contact Commonwealth Psychotherapy and provide a reasonable opportunity to address the concern informally, unless immediate legal action is necessary or applicable law provides otherwise.

This section does not apply to clinical grievances, licensing complaints, privacy complaints, professional-liability claims, or matters governed by separate professional-service agreements.

25. Termination of Site Access

We may restrict, suspend, or terminate access to the Site when reasonably necessary to protect the Site, enforce these terms, comply with law, or address abusive, fraudulent, or harmful activity.

Provisions concerning intellectual property, disclaimers, limitations of liability, governing law, and other provisions that logically survive termination will remain effective.

26. Changes to These Terms

We may update these Terms and Conditions to reflect changes to the Site, our practices, service providers, or applicable legal requirements.

Revised terms will be posted on this page with an updated "Last updated" date. Continued use of the Site after revised terms are posted indicates your acknowledgment of those revisions.

27. Severability

If any provision of these terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or severed from the terms. The remaining provisions will continue in effect.

28. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Cookie Policy, and Disclaimer, constitute the agreement governing public use of the Site.

They do not replace separate written agreements governing psychotherapy, clinical supervision, telehealth, privacy practices, fees, cancellations, or other professional services.
